Expressly under protest and without prejudice to any of His Rights, Chester E. Davis, Sui Juris, Citizen of Oregon is competent to testify and hereby does testify as follows:

I have reviewed the document entitled NOTICE AND DEMAND FOR CERTIFIED EVIDENCE OF OATH, as transmitted to Mr. Charles D. Ferrari at the Oregon Department of Justice via U.S. Mail dated May 29, 2003 A.D. by Mr. Paul Andrew Mitchell, Author, Damaged Party and Plaintiff in California Superior Court docket #GIC807057; and, I hereby incorporate said document by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the document entitled NOTICE AND DEMAND TO CEASE AND DESIST, as transmitted to Mr. Charles D. Ferrari at the Oregon Department of Justice via U.S. Mail dated June 19, 2003 A.D. by Mr. Paul Andrew Mitchell, Private Attorney General, 18 U.S.C. 1964(a); and, I hereby incorporate said document by reference, as if the same were set forth fully here. I have reviewed the document entitled NOTICE OF DEFAULT, BY AFFIDAVIT, as transmitted to Mr. Charles D. Ferrari at the Oregon Department of Justice via U.S. Mail dated March 12, 2004 A.D. by Mr. Paul Andrew Mitchell, Author, Damaged Party and Plaintiff; and, I hereby incorporate said document by reference, as if the same were set forth fully here. I have reviewed the letter signed by Mr. Charles D. Ferrari, as transmitted to Mr. Paul Andrew Mitchell on May 11, 2004 A.D., and I have also reviewed the copy of said letter that is annotated by Mr. Paul Andrew Mitchell with the following words: “Refused for fraud, mail fraud, and witness retaliation: no Oath of Office; no Power of Attorney; Sender is an Impostor and a Liar: RTS” [Return To Sender]; and, I hereby incorporate both letters by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the document entitled NOTICE OF CRIMINAL INVESTIGATION, as transmitted to Messrs. Hardy Myers and Peter D. Shepherd at the Oregon Department of Justice via U.S. Mail dated May 14, 2004 A.D. by Mr. Paul Andrew Mitchell, Private Attorney General and Damaged Party; and, I hereby incorporate said document by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the document entitled MIRANDA WARNING, as transmitted to Mr. Charles D. Ferrari at the Oregon Department of Justice via U.S. Mail dated May 21, 2004 A.D. by Mr. Paul Andrew Mitchell, Private Attorney General (18 U.S.C. 1964(a)); and, I hereby incorporate said document by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the letter signed by Mr. Charles D. Ferrari, as transmitted to Mr. Paul Andrew Mitchell on May 24, 2004 A.D., and I have also reviewed the copy of said letter that is annotated by Mr. Paul Andrew Mitchell with the following words: “Refused for bad faith, fraud, witness retaliation, undue delays; no federal jurisdiction: 18 U.S.C. 1964(a); Superior Court #GIC807057 RTS”; and, I hereby incorporate both letters by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the letter signed by Mr. Charles D. Ferrari, as transmitted to Mr. Paul Andrew Mitchell on November 1, 2004 A.D., and I have also reviewed the copy of said letter that is annotated by Mr. Paul Andrew Mitchell with the following words: “Refused for Fraud, Mail Fraud, Witness Retaliation, Obstruction of Justice, Impersonation and Racketeering; statute in question is unconstitutional; no credentials for Drozd, Shubb, Trott, Ginsburg, Breyer, Thomas, or England: 5 U.S.C. 2906 RTS”; and, I hereby incorporate both letters by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the letter signed by Mr. Charles D. Ferrari, as transmitted to Mr. Paul Andrew Mitchell on December 23, 2004 A.D., and I have also reviewed the copy of said letter that is annotated by Mr. Paul Andrew Mitchell with the following words: “Refused for Fraud: assumes facts not in evidence, i.e. missing credentials; no oath of office: violates 4 U.S.C. 101, 18 U.S.C. 2, 3, 1341, 1512, 1513, 912 and 1962; addressee is not an ‘officer of the government’ [sic] but a Private Attorney General under 18 U.S.C. 1964 and 483 U.S. 151 (1987); see Attached -- RTS”; and, I hereby incorporate both letters by reference, as if the same were set forth fully here. (See attached.)

I have reviewed the document entitled MEMO, as transmitted to Mr. Peter D. Shepherd at the Oregon Department of Justice via U.S. Mail dated January 14, 2005 A.D. by Mr. Paul Andrew Mitchell, B.A., M.S., Plaintiff and Private Attorney General, 18 U.S.C. 1964(a): Superior Court of California docket #GIC807057; and, I hereby incorporate said document by reference, as if set forth fully here. (See attached.)

I have reviewed the document entitled FINAL NOTICE AND DEMAND FOR EXHIBITION OF MISSING CREDENTIALS, as transmitted to Mr. Charles D. Ferrari at the Oregon Department of Justice via U.S. Mail dated January 15, 2005 A.D. by Mr. Paul Andrew Mitchell, Private Attorney General, 18 U.S.C. 1964(a); and, I hereby incorporate said document by reference, as if the same were set forth fully here. (See attached.)

I have also reviewed a letter which is presently available on the Internet as written to Andrea R. Meyer at the American Civil Liberties Union of Oregon on May 2, 2005 by Mr. Peter D. Shepherd dba Deputy Attorney General. On Page 1 of 4 total pages, said letter makes reference to “Assistant Attorney General Charlie Ferrari” [sic] and “Assistant Attorney General Ferrari” [sic]. (See attached.)

I now attach true and correct copies of all documents expressly incorporated above. (See all attached documents.)
