MEMO

TO:        Gregory Nicolaysen

FROM:      Teresa Giordano

Dear Gregory:

Please read the U.S. Supreme Court case of Johnson v. Zerbst, 304 U.S. 458, 468 (1938), as soon as possible.

I did not have effective assistance of Counsel for My defense at the first preliminary hearing and, as a direct result the Court has ousted itself of jurisdiction.

Since you evidently do not have a valid license to practice law in the State of California, with a certificate of oath properly indorsed upon that license to practice law, then the Court could not have appointed you to represent Me in any capacity whatsoever.  See Section 6067 of the California Business and Professions Code, available at findlaw.com.

Even if you did have a valid license to practice law, I never consented to being represented by you;  I do not consent to being represented by you;  and, I do not consent to giving you any general or limited powers of attorney.

I reserve all of My fundamental Rights and waive none.

You have until 5:00 p.m. tomorrow to prove to Me that you do have a valid license to practice law, with a certificate of oath properly indorsed upon that license.  Beyond that deadline, you will be in legal default, and in violation of Sections 6126 and 6127 of the California Business and Professions Code (misdemeanor and contempt of court, respectively).

In any event, I will proceed to assert and to defend My fundamental Right to effective assistance of Counsel, which is guaranteed to Me by the Sixth Amendment in the U.S. Constitution.

I will deal with the remainder of your April 17 MEMO later today, or tomorrow.  I am justifiably shocked at your callous attitude about the medical emergency now facing Mr. and Mrs. Michael Marshall.

Are you out of your mind?

Mrs. Marshall is facing a possible miscarriage of her pregnancy, and you want to put blame on Me because her husband wants to be with her during this medical emergency?  I do feel that your attitude warrants an ethics complaint, at least, if not also court-ordered sanctions.

Last but not least, it is evident to Me that my confidential conversations with the Counsel and Private Attorney General I have retained are being wire‑tapped.  I demand that these violations of My privacy cease and desist IMMEDIATELY!

Sincerely yours,

Teresa Giordano
