Subject:  The Dime Savings Bank of New York, FSB v.
          Annette K. Hand et al., Supreme Court of the
          State of New York, County of Suffolk, #20987/96

Dear Attorney General:

     Please take  formal notice  of the  fact that Mr. Kenneth A.
Auerbach, Esquire  [sic], has  been appointed to act as "Referee"
in the above entitled case.

     We,  the   Defendants,  hereby   formally  object   to  this
appointment,  because   it  violates   the  original   Thirteenth
Amendment and  also the  prohibition against  Titles of  Nobility
which is  found in  the organic  U.S. Constitution  at Article I,
Section 10, Clause 1.

     Please take  formal notice also that said Clause omitted any
penalties for  exercising Titles  of Nobility,  and the  original
Thirteenth Amendment  cured  this  omission  by  adding  two  (2)
specific penalties:   loss  of citizenship,  and disqualification
from ever serving in any public office anywhere in America (state
and federal governments).  This Amendment became Law in 1819.


                             DEMAND

     Accordingly,  formal   Demand  is  hereby  made  of  you  to
institute  Quo   Warranto  proceedings  against  Mr.  Kenneth  A.
Auerbach, on  or after  Monday, May  19, 1997,  and no later than
5:00 p.m. on Friday, June 20, 1997.  See Tenth Amendment.


                       NOTICE OF DEADLINE

     If you fail to commence Quo Warranto proceedings against Mr.
Kenneth A.  Auerbach before  5:00 p.m.  on Friday, June 20, 1997,
for attempting  unlawfully to exercise the power(s) of Referee in
the above  entitled case, We the Undersigned hereby notify you of
Our intent  to petition  a court  of competent  jurisdiction  for
leave to  institute Quo  Warranto proceedings  in Our  Own stead,
given the failure of your office to do same.
