SUBJECT:  Oregon Revised Statutes, section 124.100

          as applied to Tort Claim 1 of 5

 

 

Greetings Attorney General Sessions:

 

This is a formal request that your Office show cause why the Oregon elder abuse statute at ORS 124.100 should not be applied to my pending Tort Claim 1 of 5 duly submitted under the Federal Tort Claims Act and under the Administrative Dispute Resolution Act of 1996.

 

You will kindly take Actual Notice of the definitions at ORS 124.100(1)(a) where “elderly person” means a person 65 years of age or older, and at ORS 124.100(1)(e) where “vulnerable person” means an elderly person.  I was born in Worcester, Massachusetts, in June 1948.  As such, my age qualifies me as an elderly person and as a vulnerable person, as defined by those ORS sections.

 

At ORS 124.100(2)(a), please also see in particular where a vulnerable person who suffers financial abuse is entitled to an award equal to three times all economic damages.  Applying that triple damage multiplier, the actual damages showing on Tort Claim 1 of 5 can now be increased three-fold, as follows:

 

                            $65,725,905.00

            TOTAL DAMAGES: $197,177,715.00

Within thirty (30) calendar days, kindly show cause why the Treasury of the United States should not be served with a proper INVOICE for the latter TOTAL DAMAGES.

 

Kindly also take special note that a full year has now transpired without any reply(s) from your Office to the enclosed FORMAL REQUEST FOR REFERRAL TO ALTERNATIVE DISPUTE RESOLUTION.

 

I believe I deserve a full explanation for such gross negligence.
