Re: Robert Schmitt
November 16, 2003
Dear Mr. Kurt Malizio,
Please be advised that the
undersigned has lawfully demanded of Robert Schmitt the production of his Oath
of Office pursuant to 4. U.S.C. 101. Mr.
Schmitt has fallen silent to my lawful DEMAND.
When there is a legal obligation to respond and no there is no response,
constitutes fraud pursuant to the court opinion in U.S. v. Tweel, and it will also activate estoppel
pursuant to Carmine v. Bowen.
The federal criminal statute at 18 U.S.C. 4 (misprision
of felony) creates a serious and formal obligation for me to report felony
federal offenses which I witness to a judge or other appropriate officer of the
United States (federal government).
Please be advised that I have no intentions of violating this statute.
Impersonating an employee, or acting under the authority of the United
States or any department, agency or officer thereof is a felony federal
offense, in violation of 18
U.S.C. 912. (See attached NOTICE AND
DEMAND FOR EXHIBITION OF OATH)
Sincerely, and without prejudice,
/s/ Russell MacDonald, DC
Federal Witness 18 U.S.C. §§1964(a), 1512, 1513, 1961, et seq.
