SUBJECT: Alleged SUBPOENA TO TESTIFY BEFORE GRAND JURY

on February 28, 2002 @ 9:30 a.m.

Greetings Grand Jury Foreperson:

Attached please find an original VERIFIED CRIMINAL COMPLAINT against Ms. Alicia Villarreal and Mr. Andrew Erath for several violations of 18 U.S.C. 371, 1001, 1962 and 28 U.S.C. 530B. I concur completely with the AFFIDAVIT OF PROBABLE CAUSE contained in said COMPLAINT.

The alleged SUBPOENA appears to be fraudulent on its face. As such, it constitutes material evidence of felony federal offenses, which 18 U.S.C. 4 now requires me to report to a judge of the United States.

Please be advised of My specific intent to fulfill all specific legal obligations under 18 U.S.C. 4 to report these felony federal offenses to an appropriate federal judge with all deliberate speed.

Please also be advised that I am a Co-Plaintiff in a civil lawsuit now proceeding in the District Court of the United States, Central District of California, Judge Florence-Marie Cooper presiding, Clerk’s docket number #99-13100-FMC(MANx). I encourage the grand jury to review this entire docket file without further delays.

The events described in the amended COMPLAINT in that lawsuit, and in the verified statement contained in the enclosed VERIFIED CRIMINAL COMPLAINT, have rendered Me a Federal Witness under 18 U.S.C. 1512 and 1513. I am not, however, in the Federal Witness Protection Program.

Pursuant to the statute at 18 U.S.C. 1504, I specifically request an opportunity to appear before a lawfully convened federal grand jury to testify concerning those events (see second paragraph of that statute).

Accordingly, I regard the bogus SUBPOENA TO TESTIFY BEFORE GRAND JURY to be material evidence of further criminal retaliation against Me by Ms. Alicia Villarreal and Mr. Andrew Erath, in violation of 18 U.S.C. 1512 and/or 1513. The penalties for violations of these criminal statutes are quite severe.

My own VERIFIED CRIMINAL COMPLAINT will be forthcoming, as soon as the necessary research and clerical work are perfected.
