COMES NOW  Paul Andrew  Mitchell, Sui Juris,  Citizen  of Arizona

state, expressly  not a  citizen of  the United  States ("federal

citizen") and Plaintiff in the above entitled matter (hereinafter

"Plaintiff"), respectfully to object to the assignment of a judge

pro tempore  to the  instant case;   to apply for leave from this

honorable Court to amend the original complaint, in order to name

additional defendant(s);  and to  provide formal  Notice  to  all

interested party(s)  of same, and of Plaintiff's intent to remove

the instant case to the Superior Court of Arizona, Pima county.

     To  these   ends,  Plaintiff   testifies  to   a   telephone

conversation which  Plaintiff had with the Clerk of this Court on

May 7, 1997, in which said Clerk helped Plaintiff to decipher the

illegible writing  on this  Court's  CIVIL  MINUTE  ENTRY,  dated

5/1/97 and mailed on 5/5/97 in the instant case, to wit:

     An attorney  having made  an appearance  the matter is taken
     out of  mediation  (vacate  mediation)  and  assigned  on  a
     permanent basis to Judge W. U. Weber.       [emphasis added]

     Said  Clerk  stated  to  Plaintiff,  during  this  telephone

conversation, that  "Judge W.  U. Weber"  is a judge pro tempore.

Said Clerk  also explained that such an assignment was not proper

in the  instant case,  for reasons  which said  Clerk  failed  to

explain.

     Plaintiff also respectfully requests leave of this honorable

Court to  amend the  original complaint  in the  instant case, in

order to name additional defendant(s).

     Plaintiff also  wishes to  provide  formal  Notice  to  this

honorable Court,  and to  all interested party(s), of Plaintiff's

intent, expressed  hereby, to  remove the  instant case  into the

Superior Court  of Arizona,  Pima county.   See  caption at  Form

II(b), WARRANT  FOR ARREST  (SUPERIOR COURT),  Arizona  Rules  of

Court, State and Federal, West Publishing Company, p. 204 (1994).


                        REMEDY REQUESTED

Wherefore, Plaintiff  respectfully requests assignment of a judge

who has  been appointed  to  a  regular  term.    Plaintiff  also

requests leave  to amend the original complaint, in order to name

additional defendants.    Lastly,  Plaintiff  requests  mandatory

judicial notice by this Court of Plaintiff's intent to remove the

instant case to the Superior Court of Arizona, Pima county.


                          VERIFICATION

I, Paul  Andrew Mitchell, Sui Juris, hereby verify, under penalty

of perjury,  under the  laws of  the United  States  of  America,

without the "United States", that the above statement of fact and

law is  true and  correct, to the best of My current information,
