SO LET IT BE KNOWN that I, Paul Andrew Mitchell, Sui Juris,
Citizen of Arizona state and expressly not a citizen of the
United States, do hereby give formal notice to you that, upon My
verified petition, a copy of which is served herewith, the
Undersigned will apply to the Superior Court of Arizona, on the
thirtieth (30th) day of June, 1997, at 10:00 a.m. of that day, or
as soon thereafter as the matter can be heard, for the issuance
of a Peremptory Writ of Mandamus to compel the Pima County
Consolidated Justice Court:
Notice of Petition for Peremptory Writ of Mandamus:

(1) to certify in the official docket that a verified
pleading has been filed in the case of Mitchell v. Nordbrock,
Pima County Consolidated Justice Court case number #CV-97-3438,
which states as a counterclaim a claim in which the amount
involved, exclusive of interest and costs, is more than five
thousand dollars ($5,000.00);
(2) to stop further proceedings in the action at once; and
(3) to forward all papers, together with a certified copy
of all docket entries, to the Superior Court of Arizona, where
the action shall be docketed and determined as though originally
brought in said Superior Court.
Said Peremptory Writ of Mandamus will be requested of this
honorable Court, pursuant to ARS 22-201(F) and to the grant of
original jurisdiction over mandamus made to this Court under
authority of ARS 12-2021, to wit:
A writ of mandamus may be issued by the supreme or superior
court to any person, inferior tribunal, corporation or board
... to compel, when there is not a plain, adequate and
speedy remedy at law, performance of an act which the law
specially imposes as a duty resulting from an office, trust
or station ....
Petitioners hereby allege that no plain, adequate and speedy
remedy at law is otherwise available to effect transfer of the
case in question to the Superior Court of Arizona.
EXEMPTION FROM DOCKET FEE
Petitioner claims an exemption from payment of any docket
fee for the requested Writ of Mandamus, pursuant to the provision
in ARS 22-201(F) which states that "no other party in the action
before the justice of the peace shall be required to pay any
sum." Petitioner falls within the scope of the term "no other
party" as that term is utilized in said provision.
