Hale, Sui Juris, a named Defendant in the above entitled case, without waiving or conferring any jurisdiction, specifically to request that this honorable Court take mandatory judicial notice of the fact that, on February 24, 2005, a CIVIL SUBPOENA was issued to Kirk E. Giberson, Counsel for the Plaintiff, by the Clerk of the Superior Court of Solano County, demanding production of a valid license to practice law with certificate of oath indorsed upon said license, as required by sections 6067 and 6068 of the California Business and Professions Code (see “duties”).

A true and correct copy of said SUBPOENA is attached hereto and incorporated by reference, as if set forth fully here.
