NOTICE OF DEFAULT, BY AFFIDAVIT

 

I hereby testify to the fact that Kirk E. Giberson, attorney for the plantiffs, Redwood Plaza Investments, L.P., has now failed to provide me with a copy of the lawful license to practice law that conforms to Section 6067 of the State Bar Act, after receiving my proper and lawful request for same via U.S Mail. Copies of the requests are attached hereto and incorporated by reference, as if set forth fully here.

 

Therefore, I am now proceeding on the basis of my determinations that  his silence is a fraud, pursuant to U.S. v. Tweel, 550 F.2d 297, 299 (1977) (silence can only be equated with fraud where there is a legal or moral duty to speak, or where an inquiry left unanswered would be intentionally misleading). Also, when such an attorney is fully and timely notified via proper Legal Notice of the law that they are violating under section 6068, i.e. to obey section 6067 because the latter is a California State law, and then they consciously decide not to cure their original omission and, as such, they commit a deliberate and premeditated violation of sections 6126, 6127, and 6128.
