ACTUAL NOTICE OF RELATED FEDERAL CRIMINAL STATUTES

 

RE: 

ICC reference:  OTP-CR-473/21 (CRIMINAL COMPLAINT proprio motu);

International Covenant on Civil and Political Rights, Article 6(2) and 6(3); 

Convention on the Prevention and Punishment of the Crime of Genocide;  

18 U.S.C. 1091 (Genocide -- implementing latter Convention);  and,

18 U.S.C. 2441 (War crimes)

 

TO:  All Whom It Concerns Presently and Henceforth

 

Although the United States is not presently a State Party to the Rome Statute,

the United States is a State Party to the Covenant and Convention both cited above;  and,

the U.S. laws at 18 U.S.C. sections 1091 and 2441 are enforceable criminal statutes

as enacted into positive law and codified in Title 18 of the United States Code

(hereinafter "18 U.S.C.")

 

Notably, section 2441 supra prohibits war crimes "whether inside or outside the United States".

 

Similarly, section 1091 supra expands jurisdiction "regardless of where the offense is committed."

 

All of the above are submitted into evidence by way of supplementing all prior NOTICE(s)

which allege violations of the Biological Weapons Convention, its implementing statutes,

and the related U.S. laws which also expressly define 18 U.S.C. 175-178 and 2332b(g)(5)(B)

as racketeering "predicate acts", chiefly 18 U.S.C. 1961(1)(B) and (1)(G).  All such prior NOTICE(s)

and citations are hereby incorporated by reference as if set forth fully here.

 

 

Accordingly, the People of the United States of America ex rel. Paul Andrew Mitchell, B.A., M.S.,

hereby provide ACTUAL NOTICE of our specific intent to supplement our

application for leave to intervene by alleging violations of each of the following applicable

criminal laws currently in force in the United States of America, with particular emphases

on the Convention on the Prevention and Punishment of the Crime of Genocide

as formally implemented by 18 U.S.C. 1091, and also Article 6(2) and 6(3) in the

International Covenant on Civil and Political Rights, to wit:

2.   In countries  which have  not abolished  the death  penalty,
sentence of death may be imposed only for the most serious crimes
in accordance with the law in force at the time of the commission
of the  crime and  not contrary  to the provisions of the present
Covenant and  to the  Convention on the Prevention and Punishment
of the  Crime of  Genocide.
 This penalty can only be carried out
pursuant to a final judgement rendered by a competent court.

 

3.   When deprivation  of life constitutes the crime of genocide,
it is understood that nothing in this article shall authorize any
State Party  to the  present Covenant to derogate in any way from
any obligation  assumed under the provisions of the Convention on
the Prevention and Punishment of the Crime of Genocide.

 


The United States ratified that Convention on the Prevention and
Punishment of the Crime of Genocide
in December 1948 and
received same from the U.S. President on 06/16/1949:
