Greetings Mr. Lee:
Have you retained a lawyer in connection with the matters described in the attached?
After a review of Washington State laws cited by UW’s Office of Risk Management, it is now apparent that those laws do not authorize the UW Board of Regents to indemnify or otherwise “self-insure” any UW personnel from liability for damages caused by criminal conduct.
Although tortious interference and gross negligence (i.e. failure to perform duties and responsibilities) may be covered by RCW 28B20.250 and RCW 28B20.253, violations of 18 U.S.C. §§ 241, 242, 1341, 1343, 1344, 1512, 1513, 1961, 1962, 1964 and/or RCW 9A.80.010 do not appear to be covered; such crimes are not expressly mentioned.
Moreover, insofar as there are any conflicts between Washington State laws and the U.S. Constitution or laws enacted by Congress, laws enacted by the Washington State Legislature have no standing, pursuant to the Supremacy Clause in the U.S. Constitution.
If you have retained Counsel in this matter, kindly request your Counsel contact me as soon as possible.
The damages to my business and career plans continue to accumulate for more than 4.5 years now, with no end in sight.
A just resolution, such as a private equitable settlement, now appears to be in the best interests of all concerned.
Thank you for your consideration.
Sincerely yours,
/s/ Paul A. Mitchell
