This is a lawful request under the Freedom of Information Act (“FOIA”), 5 U.S.C. 552 et seq.  Please provide me with a certified copy of the following documents:

 

1.   written request of the Secretary seeking to expand the subject grand jury to include potential tax violations, in U.S.A. v. Wishart, USDC San Jose, Calif., #CR‑00‑20227‑JF, as required by 26 CFR 301.6103(h)(2)-1(a)(2)(ii) and by U.S. Attorney’s Manual (“USAM”) sections 6-4.122(D) … (5) and 6-4.123 (i.e. “copy of request seeking to expand …”);

 

2.   proof of certified mail used to transmit written request identified in point 1 above;

 

3.   written authorization, or written sanction, of the Secretary which authorizes or sanctions the proceedings in U.S.A. v. Wishart, USDC San Jose, Calif., #CR‑00‑20227‑JF, as required by Internal Revenue Code section 7401 (note: no regulations are evident for this statute, however).

 

I request a waiver of all fees for this request.

 

Disclosure of the requested information to Me is in the public interest, because it is likely to contribute significantly to public understanding of the operations and activities of the federal government, and is not primarily in My commercial interest.  See also 5 U.S.C. 552(a)(4)(B).
