SUBJECT: Oaths of Office
Dear Mr. Mecham:
I have not received any response from you to My lawful demands, previously mailed directly to you, for certified copies of the Oaths of Office for Mr. Jeremy Fogel and Ms. Patricia V. Trumbull, claiming to be judge and magistrate, respectively, at the USDC, San Jose, California.
Although Congress has been remiss for failing to legislate clear procedures for compelling disclosure of these Oaths, I am advised by Counsel that your office has produced certified copies of these Oaths in recent years. Thus, I must conclude that you are the lawful custodian of the Oaths of Office for all federal judges.
Accordingly, because time is of the essence in U.S.A. v. Wishart and Wishart v. U.S. et al., San Jose docket number #CR‑00‑20227‑JF, I now make this formal DEMAND that you produce certified copies of both Oaths of Office, and transmit same to Me, at the mailing location shown above, no later than 5:00 p.m. on Friday, October 6, 2000 A.D.
Failing your timely assistance in this matter, which arises under Article VI, Clause 3, in the Constitution for the United States of America, as lawfully amended, I will infer from your silence that no such Oaths exist, as a matter of fact. See also 28 U.S.C. 453.
