NOTICE AND DEMAND

TO CEASE AND DESIST

TO:       Jeffrey A. Blair

c/o Office of the General Counsel

          University of California

          1111 Franklin Street, 8th Floor

          Oakland 94607-5200

          CALIFORNIA, USA

FROM:     The People of California State ex rel.

          Paul Andrew Mitchell, B.A., M.S.

          Private Attorney General

DATE:     July 29, 2003 A.D.

SUBJECT:  Missing License and Certificate of Oath as required by

CBPC §§ 6067, 6068 and the Oath of Office Clause (6:3)

Dear Mr. Blair:

NOTICE

You are hereby reminded of my prior written correspondence to you in the matter of your missing license to practice law in the State of California.  Copies of that written correspondence are posted at the following Internet URL:

          http://www.supremelaw.org/copyrite/blair/

You are also reminded of the VERIFIED CRIMINAL COMPLAINT against you, for violating sections 6126 and 6127 of the California Business and Professions Code (“CBPC”), and also the federal criminal statute at 18 U.S.C. 242.  See Internet URL:

          http://www.supremelaw.org/cc/aol/criminal.complaint.3.htm

The latter CRIMINAL COMPLAINT was served via U.S. Mail upon your office, upon the offices of the State Bar of California in San Francisco and Los Angeles, and upon the Clerk of the California Supreme Court.  See PROOF OF SERVICE in same.

I believe it is your legal and ethical obligation to report such formal charges to the State Bar of California, since you are claiming to be a member in good standing of that State Bar.

However, I now act on the basis of your decision to remain silent in direct response to my previous lawful demand for exhibition of the certificate of oath that is required to be indorsed upon your license to practice law in the State of California.

Silence is a fraud, where there is a legal or a moral duty to speak, or where an inquiry left unanswered would be intentionally misleading.  U.S. v. Tweel.  Silence activates estoppel.  Carmine v. Bowen.

Thus, I am refusing your written communications transmitted via U.S. Mail, for fraud, mail fraud, willful misrepresentation, and conspiracy.

I specifically deny that you are a member in good standing of the State Bar of California.

DEMAND

I hereby demand that you immediately cease and desist from any further attempts falsely to represent The Regents of the University of California, or to transmit any further false and misleading representations of fact via fax or U.S. Mail, or to attempt any false and fraudulent “appearances” on behalf of anyone or anything else in State or federal courts, without first exhibiting proof that you have properly indorsed upon your license to practice law a certificate of your oath to support the Constitution of the United States and the Constitution of the State of California, and faithfully to discharge the duties of an attorney at law to the best of your knowledge and ability.

If you need help understanding this NOTICE AND DEMAND TO CEASE AND DESIST, allow me to recommend that you retain the services of competent counsel who is properly licensed to practice law in the State of California.  I don’t know of any and, even if I did, it would not be proper for me to recommend any such counsel to you in this matter.  See also CBPC § 6068.

Thank you for your immediate cooperation.

Sincerely yours,

/s/ Paul Andrew Mitchell
