NOTICE OF FAILURE TO DESIGNATE

AGENT FOR NOTIFICATION OF CLAIMS

OF CRIMINAL COPYRIGHT INFRINGEMENT

Dear President:

 

Enclosed please find an original, signed document which we have entitled NOTICE OF INTENT TO SUE AND PROSECUTE VERIFIED CRIMINAL COMPLAINTS, and which is hereby served upon you.  We have also enclosed a similar NOTICE OF INTENT which was recently mailed to the Offices of the Presidents of all universities and colleges named therein.

 

We have received a letter dated August 2, 1999, from Walter P. DeForest (copy attached), alleging to be an Attorney at Law [sic].  Please be advised that we will not reply to said letter, until such time as we receive a certified copy of his oath of office, license to practice law in the Commonwealth of Pennsylvania, and power(s) of attorney to represent Carnegie Mellon University in this matter.

 

Please be informed that Carnegie Mellon University has failed to designate an agent for notification of complaint(s) of criminal copyright infringement, pursuant to 17 U.S.C. 512(c).  Until such time as you have designated such an agent and properly informed the U.S. Copyright Office, your institution cannot claim immunity under the Digital Millennium Copyright Act of 1998.  See enclosed evidence in this regard.

 

The evidence available to us indicates that one Karl Kleinpaste has, at various times in the past, utilized the Internet file servers at Carnegie Mellon University to disseminate a stolen and modified, derivative copy of "The Federal Zone: Cracking the Code of Internal Revenue," electronic edition, and to provide users of the World Wide Web ("WWW") with explicit instructions for obtaining additional stolen and modified copies of same.

 

In the absence of a properly designated agent for notification of claims of criminal copyright infringement, we will continue to hold your office responsible for satisfying this legal requirement.
