COME NOW  the People of the United States of America (hereinafter

"Petitioners"), ex  relatione Paul  Andrew, Mitchell, B.A., M.S.,

Citizen of  Arizona state,  expressly not a citizen of the United

States ("federal citizen"), federal witness, and Counselor at Law

(hereinafter  "Relator"),   to  provide   formal  Notice  to  all

interested party(s),  and to  demand mandatory judicial Notice by

this Court, pursuant to FRAP Rules 3 and 4 and to 28 U.S.C. 2107,

of Petitioners'  Appeal to the United States Court of Appeals for

the Ninth  Circuit, from all orders issued by Chief United States

District Judge  Jack D. Shanstrom from the United States District

Court ("USDC"), specifically including, but not limited to:


                 Notice of Appeal:  Page 1 of 3


     (1)  the most  recent ORDER  dated  May  22,  1997,  denying
          Petitioners' request  that the  District Court  of  the
          United States ("DCUS") certify this case for appeal;

     (2)  the ORDER  of April 8, 1997, remanding the instant case
          back to  the Montana Sixteenth Judicial District Court,
          Garfield County;  and,

     (3)  all other  ORDER's which  have allegedly been issued in
          the instant  case by  the Honorable  Jack D. Shanstrom,
          presiding on the USDC, but not on the DCUS.

     The Clerk  of the  District  Court  of  the  United  States,

Judicial  District  of  Montana,  Billings  Division,  is  hereby

respectfully requested  to transfer the entire docket file to the

Clerk of  the United  States  Court  of  Appeals  for  the  Ninth

Circuit.

     The most recent information available to Petitioners is that

the entire  docket file  of the  instant case  has  already  been

transmitted to  the Montana  Sixteenth Judicial  District  Court,

Garfield County,  pursuant to Judge Shanstrom's ORDER dated April

8, 1997.  Petitioners previously received written confirmation of

this fact from the Clerk of said Garfield County court.
