17.33   E.  Allegation in Complaint: Compliance With Claim
                               Requirement

   On __[date]__, __[plaintiff/cross-complainant]__ presented a claim
for the __[injury/damage/loss]__ that is the basis of this action to
__[name of entity]__. On __[date]__, that claim __[was rejected in its
entirety/was allowed to the extent of $_ _ _ _ _ _ but otherwise
rejected/had not been acted on and was thus deemed to have been
rejected]__.

   Comment: A complaint that fails to allege compliance with an
applicable claim requirement is demurrable for failure to state a cause
of action. See 17.4.
