NOTICE OF DEFECTIVE DELEGATION OF AUTHORITY:

5 U.S.C. 2902(c)

TO:

President Donald J. Trump

1600 Pennsylvania Avenue, N.W.

Washington 20500

District of Columbia, USA

Subject:  Mr. Merrick Garland dba U.S. Attorney General (former)

Date:  March 27, 2025 A.D.

Greetings Mr. President:

We write this time to request your priority attention to a recent development in The Credential Investigation.

The enclosed documentation goes into much greater detail, so a shorter Executive Summary is warranted here.

The Act of Congress at 5 U.S.C. 2902(c) is very clear and specific where it requires the U.S. Attorney General to countersign all PRESIDENTIAL COMMISSIONS for all Federal judicial officers.

That duty may not be performed lawfully if the person claiming to be the Attorney General was never duly commissioned by the President.

The latter situation arises if a valid PRESIDENTIAL COMMISSION was never issued to that person, or if a counterfeit COMMISSION was “signed” with a robotic signature (“auto pen”).

If Mr. Merrick Garland was never duly commissioned, then it necessarily follows that he was never authorized to countersign any COMMISSIONS for any U.S. Government officials who claim to be lawful Federal judges.

Under those conditions, there has been a break in the chain-of-command near the top, and all subordinate links in that chain also lack the requisite delegations of authority.

In pursuit of further confirmation, and to demonstrate sufficient due diligence in this important matter, we recently submitted an abbreviated request under the Freedom of Information Act for electronic copies of any PRESIDENTIAL COMMISSIONS issued to Merrick Garland during Joseph Biden’s period in the White House.

The latter FOIA Request deserves to be expedited by the Initial Request Staff at DOJ’s Office of Information Policy (“OIP”).

The latter elevated priority is further warranted by our related finding that Merrick Garland’s mandatory SF-61 APPOINTMENT AFFIDAVITS were another instance of known counterfeit credentials.

Such fatal defects constitute another pivotal reason why Merrick Garland was unable lawfully to countersign PRESIDENTIAL COMMISSIONS for any U.S. Government officials claiming to be duly appointed Federal judges.

We are not presuming here to offer any unique insights into any of your Executive Orders, whether already signed by you, or anticipated at some future date(s).  That is not the primary purpose of the instant NOTICE.

It is primarily the absence of valid PRESIDENTIAL COMMISSIONS that now appears to nullify all actions taken against your Executive Orders by certain personnel now claiming to be U.S. District and Circuit Court “judges”.

Even if a valid OATH OF OFFICE is confirmed for any of such Court officials, they may not be legally qualified by taking such Oaths until they are issued valid PRESIDENTIAL COMMISSIONS!  See case law attached.

This mandatory sequence can be easily confirmed by any fair reading of applicable Clauses in the U.S. Constitution and the Acts of Congress which have implemented those Clauses (see all attached).

Thank you very much, Mr. President, for giving all of the above your elevated priority attention.

We are standing by to assist your high Office pro bono.

Sincerely yours,
/s/ Paul Andrew Mitchell, B.A., M.S., Retired / pro bono
