You are missing the point, Linda.

This is "political" action.  Even
if you are correct about your
technical definition of "witness,"
the facts call for a proper engineering
analysis of that explosion.  Moreover,
Rehnquist is paying taxes on his judicial
pay, so he is disqualified from sitting
on any case arising under the Constitution,
laws, or treaties of the United States,
pursuant to Article III, Section 1.
