Dear Beverly,

There is a basic privacy defense which
you should invoke now, because releasing
the names of your customers was not
part of your contract with those customers;
and turning over their names would not
only violate their privacy, but it would
also violate your implied contract with
them. The "receipt" which you gave them
did not say their names would be given to the
DEA, under any circumstances. The key here
is that privacy is a fundamental Right, and
the DEA cannot impair the obligations of
your contract(s) with your customers.

Therefore, begin by submitting FOIA requests
to each of the DEA agents who are on this
case right now, and apply for a stay of any
further administrative and/or judicial proceedings,
pending discovery of the documents requested under
the FOIA. If you are lucky enough to obtain
certified copies of their Appointment Affidavits,
you can invoke the U.S. Constitution against them,
which contains an explicit prohibition against
impairing the obligations of contracts. You have
a "contract implied in fact" with your customers;
if you secretly intended all along to violate the
privacy of your customers, then the names you
acquired were obtained unlawfully. I am arguing
in the "inverse" here (reductio ad absurdum).

Therefore, you did NOT secretly intend all along
to violate their privacy, because their privacy
is a fundamental Right which cannot be violated,
without committing a serious felony. Your contract
implied in fact must be construed to enforce their
fundamental Rights, at all times and places.
See the Privacy Act for the declaration by
Congress that privacy is a fundamental Right.
Your contract with them is lawful, notwithstanding
any false implications which DEA may wish to draw
from your business license, driver's license,
and what have you. This is fraud, because you
never agreed to violate the privacy of your
customers, and doing so would have been unlawful
for you, in the first place.

Best regards,
/s/ Paul Mitchell
