Clerk & Bailiff: Majordomo@www.ulitmate.org ======================================================================= clearly, the institution of a grand jury predated the Constitution, since it is mentioned in the Fifth Amendment. there does seem to be a legitimate concern as to whether "federal" grand juries have any authority to convene. there is no question that "state" grand juries have authority to convene. we should go back to the intent and legislative history of the Fifth Amendment for answers to these questions. The best challenge I have seen to federal grand juries came from Velma Griggs, author of "The Original 13th Amendment."
