This BRIEF (defective process) is based on the false premise that today's 50 States (political subdivisions) are united under the We the People constitution.
Congress sits under international law which is roman based law. Executive orders are constitutional under international law.
The Lieber code is international law on file at the International Court of Justice.
Monarchs used roman based international law to issue orders as did Lincoln.
