: What you are saying here, in effect, is that
: the Mafia are "legal" because they have bigger
: guns, bigger thugs, and bigger bank accounts.

: On the contrary, we are a government by compact,
: not by force or fraud, and that compact extends
: all the way back to the Magna Charta.

: Our emphasis in this forum is Law,
: of the de jure variety, not legalities,
: of the de facto variety.

: You give the criminals too much credit.
: Are you afraid of them? You SHOULD be
: if you give them THAT much credit.

: The cases are otherwise, e.g. no one obtains
: a vested or protected right in violation of
: the Constitution. Those cases are cited,
: and quoted, in Gilbertson's OPENING BRIEF.
: Use your editor to search for "vested" [sic].

: The doctrine that "Might Makes Right" is
: totally inimical to every principle of
: freedom and justice ordained and established
: by the U.S. Constitution and the several
: state constitutions as well.

: This is the essence of a Republican Form
: of Government: the People are the source
: of legitimate power. Government employees
: are "Public Servants" (read "Servants of
: the People").

I wonder if the people of the Confederate States of America felt that way when they "Lawfully" succeeded from the Union, I know from the history that the people of the nation of Hawaii didn't feel that way when they were taken over in a military coup, I wonder how the people of the Phillipines felt when we took over their nation via military action, I wonder how the people of Panama felt when we invaded their country, seized their national leader and imposed a new government under federal supervision, to which we still occupy today, I know from experience that we promised the Saudi Arabian people we would leave right after the conflict was over in Iraq, however what Geo. Bush & Co. wanted was not an end, but a perpetual presence just like we have done in Korea for the past 40+ years. When you leave this country, visit foreign countries, and hear their stories, the term "ugly american" takes on more than a social derrogation, they mean it in a political sense. I have spent the past ten years traveling to other lands we have conquered under military authority and heard the stories pasted down to the second generations and have become disillusioned with the premise that we are a "law" abiding political body. Our present administration reveals how the "law" is regarded. Since the bankruptcy of the U.S., it is public policy that is obeyed with impunity, not public law. That is why I resist being persuaded without any evidence of a published win on these issues of substantive law. Even the great touted Long case was sealed. Why? If due process was followed, and the law upheld, why hide it from the nation?

Where's the evidence of us winning?
