: I continue to read so much about Admiralty jurisdiction, but somehow it at times seems confusing. Is there anyone out there that may, in depth, explain to us out the complete reasoning behind the above? I have documentation from congressional reports that all courts are under the above jurisdiction. That being so then, how do the courts separate that jurisdiction from common law, equity, etc?

Jim:

I WOULD BE VERY INTERESTED IN THOSE CONGRESSIONAL
REPORTS YOU SPOKE OF. PLEASE EMAIL ME (lcalz@
feist.com) TO LET ME KNOW HOW I CAN GET THEM.

For what I know of the jurisdictions and how they
are being used,
please look at the couple of responses I've made
above on the message board under "Lee". I have
about 2 dozen tapes by Howard Freeman that would
give you what your looking for. I am currently
looking for documentation that verifies the
characteristics which distinguish the different
jurisdictions as Howard explains them.

For example, he explains that under COMMON LAW
you CANNOT be COMPELLED to PERFORM ANY ACTIVITY,
i.e., follow the rules someone else created, such
as traffic laws, ordinace codes, income tax laws,
etc., unless you enter a contract "voluntarily,
intentionally and knowingly" with someone stating
that you agree to follow these rules. Since
anything that you signed did NOT explicitly list
all the terms, then you cannot be under a Common
Law Contract.

For example, your driver's license or its
application did not list the fines you would be
responsible for if you did not follow the traffic
laws, it did not even state that you had to obey
traffic laws (at least as far as I know). Another
example is the "requirement" to file an income tax
return. What contract did you sign "knowingly,
voluntarily and intentionally" that said you
agreed to file, and if you did not, you would be
fined substantial sums and maybe go to jail?
If you signed anything that the gov't can say is a
"contract", such as a W-4, where does it list
these terms? Nowhere. You are, therefore, NOT
under COMMON LAW JURISDICITION.

In addition, under COMMON LAW, in order for you to
be summoned to go to court, there must be an
INJURED PARTY, or CORPUS DELICTI, complaining
against you as proof that a crime has been
committed, and the INJURED PARTY must be another
HUMAN BEING, NOT a CORPORATION (legal fiction),
such as the STATE - how can anything you do
physically injure something which doesn't exist in
physical form, something that is just an idea in
peoples' minds? If there is NO INJURED PARTY, then
you are NOT under COMMON LAW.

If you did violate the COMMON LAW, it would be a
CRIMINAL ACT and would be punishable.

Under EQUITY LAW, you can be COMPELLED to
PERFORM to the exact letter of the CONTRACT that
you are under. If you are being compelled to
perform, then there must be a contract somewhere.
This, however, can only be a CIVIL ACTION, NOT
CRIMINAL. If you refuse to perform as directed by
the court, then you can be charged with contempt of
court, which is a criminal action.

Under ADMIRALTY/MARITIME LAW, you can be COMPELLED
to PERFORM under a CIVIL JURISDICTION with
CRIMINAL PENALTIES for not adhering to the letter
of a "INTERNATIONAL" CONTRACT. All TRAFFIC LAWS,
BUILDING CODES, ORDINANCES,TAX CODES, etc., are
under this jurisdiction. Whenever there is a
PENALTY FOR FAILURE TO PERFORM (such as "Willful
Failure to File"), you are under ADMIRALTY/
MARITIME LAW and there must be a VALID
INTERNATIONAL CONTRACT in force.

In actuality, the courts are under a "COLORABLE"
ADMIRALTY JURISDICTION, i.e., it is NOT based on
SUBSTANCE(GOLD, SILVER), but on paper with nothing
to back it.

Howard does a much better job and provides his
specific experiences with some judge friends of
his who helped him fill in the pieces to this
puzzle. Call America's Promise Ministries at
208-265-5404 ($3.50 a tape, 1 hr. ea.) to order
the tapes. Get all of them. There are a few on
his religious and cult views, but almost every
one of them has some info on law. Also, Solutions
Publishing Co., 1-888-no-1040s, has a couple of
chapters on the Uniform Commercial Code (Colorable
Admiralty Law), one a transcript of one of
Howard's tapes, in the Organic Sovereign American
Freeman Compendium, Vol. II.

I hope this helps.
