First familiarize yourself with 26 CFR Sec.31.3402.
In here it explains how your employer and you must
enter into an agreement to have him withhold, and
that the agreement can be broken at any time. Eddie
Kahn (pronounced KANE)says don't take that info
to your employer and beat him over the head with it.
He doesn't want to withhold. It's a hassle. But
he is intimidated by the IRS. Go instead to
the local IRS collections office, ask to speak to
someone in the Taxpayer Assistance Department.
Show them the documents. Tell them you are
confused. If the agent says that you are wrong,
demand to see a copy of the regulation that says
that withholding is mandatory. You have the right
to this meeting, and according to the
Administrative Procedures Act, the IRS have the
burden of proof, because they are the proponent of
the regulation. If the IRS agrees with you, ask
for a letter to that effect which you can take to
your employer. If the agent will not comply,
he is violating the law. Demand to speak to his
supervisor, and if HE will not give you an
answer, demand to see HIS supervisor and keep going up!
I would suggest the book (notebook format) from
Eddie Kahn called, "No Implementing Regulations" Call
Eddie at :352-735-5668. I don't know him, and I
am not making anything from telling you this:
I just like the book, and I've read Schiff and Vultures,
etc. Knowledge is Power. Turn off the TV and study the law!
