Allowable under California State Laws
This is our SECOND ADJUSTED INVOICE for partial damages sustained in connection with all COUNTS and the SUMMARY OF DAMAGES described in the Initial COMPLAINT in the above entitled matter, plus the maximum amount of pre-judgment interest allowable under California State usury laws (i.e. seven percent (7%) per annum simple interest).
The authority for this INVOICE is the holding in the case of Hajek v. Burlington Northern R.R. Co., 186 F.3d 1105, hn. 9 (9th Cir. 1999) (local district court rules, under which a failure to object to a magistrate’s jurisdiction was deemed to be a waiver of the right to an Article III judge, were invalid and thus not effective to confer authority upon the magistrate in the absence of express consent by all parties, since the local rules were inconsistent with the statute).
Accordingly, we now hold you liable, both jointly and severally, for all Initial Damages plus twenty-four (24) months of simple interest, beginning Aug. 1, 2001 A.D. thru and including July 31, 2003 A.D.:
