COMES NOW Paul Andrew Mitchell, Plaintiff in the above entitled case, to supplement the STATUS REPORT OF SUMMONS SERVICE as previously served on October 18, 2001 A.D.

 

Status of Named Defendants

AOL Time Warner, Inc. and Employees

     AOL Time Warner, Inc. appears to have retained the firm of Murphy, Austin, Adams, Schoenfeld, LLP, with offices in downtown Sacramento, California.  A letter to this effect was mailed on October 12, 2001, from Mr. Geoffrey A. Goodman to the Plaintiff’s Forwarding Agent.  See Attachment “A”.

     In a private email message to Plaintiff, Mr. Goodman also claims to have been retained by Defendants Steve Case, Lennert Leader, Randall J. Boe and James R. Bramson.  At this time, it appears that Mr. Goodman is uncertain if his firm will also be representing Defendants Adit Seth and George R. Boyce.

Telalink Corporation

     Defendant Telalink Corporation is represented by the firm of Steinhard & Falconer, LLP, with offices in downtown San Francisco, California.  Telalink Corporation has filed in this Court a NOTICE OF DEFENDANTS’ FILING OF BANKRUPTCY AND OF AUTOMATIC STAY, dated September 14, 2001.  See Attachment “B”.

     On behalf of Defendant University of Arkansas, the Designated Agent for Notification of Copyright Infringement Claims has filed, in the wrong court, a WAIVER OF SERVICE OF SUMMONS dated August 27, 2001.  See Attachment “C”.

     On behalf of Defendant Princeton University, the Assistant University Counsel has mailed to Plaintiff a signed WAIVER OF SERVICE OF SUMMONS, dated September 5, 2001.  See Attachment “D”.

     On behalf of Defendant Northeastern University, the Associate University Counsel has mailed to Plaintiff a signed WAIVER OF SERVICE OF SUMMONS, dated September 10, 2001.  See Attachment “F”.

     Mr. Wesley C.J. Ehlers, employed with this firm, has filed in the wrong court a STIPULATION RE: WAIVER OF SERVICE AND EXTENSION OF TIME TO RESPOND TO COMPLAINT FOR DEFENDANTS.

     Plaintiff erred by overlooking the wrong court on the caption page of same.  Plaintiff has requested Mr. Ehlers to correct this error nunc pro tunc on all future pleadings.

     All named Defendants who have retained Pillsbury, Winthrop, LLP, were previously itemized in Plaintiff’s STATUS REPORT OF SUMMONS SERVICE.

 

Update of Priority U.S. Mail

with Delivery Confirmation Status

     Delivery of Plaintiff’s Priority U.S. Mail to Defendants Leander Pearson and Burntfork Rural Systems was confirmed on October 17, 2001, in McKinnon 82938, WYOMING, USA.

     Delivery of Plaintiff’s Priority U.S. Mail to Defendants Telecode and Desert Video Production appears to have been refused, after Plaintiff transmitted email to the WHOIS contacts responsible for Internet domain CINECAM.COM, informing them that Priority U.S. Mail was being held for WILL CALL.

     See Attachment “G”.

 

Return of Service Forms

     Plaintiff completes this SUPPLEMENT by attaching true and correct copies of the RETURN OF SERVICE forms executed by the paralegal who posted the Priority U.S. Mail, with Delivery Confirmation, to Defendants whose last known, and only available, address was a USPS Post Office Box.  See Attachment “H”.
