SO LET IT BE KNOWN THAT I, MITCHELL P. MODELESKI, do hereby
give notice to you that, upon my verified petition (a copy of
which is served herewith), the undersigned will apply to the
Supreme Court of the State of California, on the first day of
December, 1992, at 10:00 A.M. of that day, or as soon thereafter
as the matter can be heard, for the issuance of a Peremptory Writ
of Mandamus to compel you:
(1) to perform your official, sworn duty to support and
defend the Constitution of the United States against all enemies,
both foreign and domestic, as required by Article 6, Clause 3 of
said Constitution and also by Section 3331 of Title 5, United
States Codes, and
(2) to keep your public spoken promise to examine the
material evidence which impugns the ratification of the so-called
16th Amendment to the Constitution of the United States.
