FORMAL NOTICE OF INTENT

TO:      Hon. John Kerry, U.S. Senator

         United States Senate

         304 Russell Building, Third Floor

         Washington 20510

         DISTRICT OF COLUMBIA, USA

FROM:    Paul Andrew Mitchell

         Private Attorney General

DATE:    January 20, 2004 A.D.

SUBJECT: VERIFIED CRIMINAL COMPLAINT, ON INFORMATION

against Donald Rumsfeld, Secretary of Defense

Dear Senator Kerry:

It is with a very heavy heart that I now formally notify you of our specific intent to lodge a verified criminal complaint against Donald Rumsfeld ‑‑ for premeditated murder and conspiracy to commit treason, in connection with the 9-11 attacks on the Pentagon and elsewhere in the United States of America.

For your information, we are in regular contact with an Officer of the Day at the U.S. Coast Guard station in downtown San Diego, California.  That Officer requested that we continue to provide their office with regular updates of our progress in this homicide investigation.

In our professional opinion, the information available to us now constitutes probable cause formally to charge Mr. Rumsfeld with being a principal directly responsible for withholding military air support which could easily have intercepted the missiles that crashed into the Pentagon.  As you know, Andrews AFB is only minutes away from the Pentagon for a supersonic jet fighter.  See also 42 U.S.C. 1986.

At this point in the investigation, we have enough information in our custody to trigger the moral and legal obligations that arise under the federal criminal statute at 18 U.S.C. 4 (misprision of felony).

We trust that your staff will ensure that this letter is copied to all interested parties within the Congress of the United States.

Thank you very much, Senator Kerry, for your continuing professional consideration in this momentous matter.

Sincerely yours,

/s/ Paul Andrew Mitchell
