Subject: PAST DUE Freedom of Information Act (“FOIA”) Request
Greetings FOIA Appeal Officer(s):
This is a proper and lawful Appeal under the Freedom of Information Act (“FOIA”).
On March 7, 2007 A.D., we requested documents under the FOIA (see attached copy of our original FOIA request).
To date, we have not received a complete reply to that FOIA request.
In that original FOIA Request, we also requested that it be forwarded without delay to the correct person(s), if it was initially directed to the wrong person(s). The attached letter dated April 9, 2007, from the Tax Division of the U.S. Department of Justice, indicates that our original FOIA Request was forwarded to them.
We hereby appeal your failure to reply timely with all requested documents.
It is our position that you now have twenty (20) working days as of April 4, 2007 (the date showing on our timely FOIA Appeal in this matter), to respond to this Appeal. See statute of limitations in the Freedom of Information Act.
If you still need additional time to locate three or four one-page documents, please reply promptly in writing with an estimated date of discovery. Time is now of the essence, because Ms. Wolfinger’s missing credentials are now a matter before the Tenth Circuit, Denver.
