Sorry, the White vs. Samsung is about
publicity rights, but nonetheless, I was
referring to his comments about creativity
and how people create by referencing others.
I quote (just one of many):
All creators draw in part on the work of those who came before,
referring to it, building on it, poking fun at it; we call this
creativity, not piracy.
Some of the people who linked to your book
claimed they did so to criticise, and this
would be "valid".
I also don't see Kozinski agreeing with the SPA,
which, quite frankly, appears to have little
clue as to how copyright law works (cf. discussions
on misc.int-property about the SPA).
