I think the reason for the confusion is that lawyers think precedents shall be the supreme law of the land. It's understandable that the Constitution has been so misconstrued if the precedents are considered in view of the Constitution. The first Congress, rather than direct by law where a trial of crime not committed in any State would be, gave power to the judicial courts of the United States not delegated in the Constitution, and levied a whiskey tax not by aportionment. The first president with the consent of Congress raised an army and levied war against a State to collect the tax directly. I don't know where the first Supreme Court was at that time, these issues were not settled judicially. But then the judicial power of the United States only extends to cases in law and equity. That's and, not or equity. If the United States is singular it's only because the judges in every State have been ignorant of their duty, or adhere to some folks who don't abide by law.....Girty.....
